I own the land plot along the constructed "Western China - Western Europe" highway close to Kainar (Blagoveschenka) at Kordai -Shu-Taraz-Almaty junction. The intended use is to maintain the farm.
However, due to the fact that this land is not suitable for irrigation, I intend to change its intended use and build there roadside service point of the "C" class.
In this regard, will I be given the permission for the construction of roadside service point on my plot along the "Western China - Western Europe" highway?
How and where do I need to obtain the permission and approval for entrance and exit to my plot from the highway? What documents and where do I need to submit them for this purpose?
How, at whose expense, and by whose force shall be laid roadbed for entrance and exit to the plot?
Is it true that a moratorium for the construction of a private roadside service points along the constructed "Western China - Western Europe" highway has been declared?
My friends told me that my intentions are ineffective, because the exit to the highway will be closed by special guardrails, and that it is almost impossible to get permisiion and approval for construction since it is not provided by the project design.
Is it really indeed?
Please kindly provide me with detailed answers to each of these questions.

Dear Aidar, for the construction of a roadside service object on your land plot you have to change the intended purpose of this plot in accordance with Article 49-1 of the Land Code of the Republic of Kazakhstan. In order to receive approval for exit construction to the roadside service object you should contact the Road agencies and provide necessary documents for this procedure in accordance with item 23-3 of the "Rules for the use of roads in the Republic of Kazakhstan" approved by the Government of the Republic of Kazakhstan on September 5, 1998 № 845 "About improving of the legal provision of road infrastructure".

Regarding the acceleration and deceleration lanes to the object due to the fact that "Western Europe - Western China" International Transport Corridor road (hereinafter - "WE - WC") is the road of the 1st technical category, in accordance with item 6.3.1 of "SNIP RK 3.03-09-2006 HIGHWAYS” at exits to the buildings and to the constructions of roadside service the acceleration and deceleration lanes in each direction should be provided. Moreover, in accordance with item 5 of Article 8 of the Law "About highways" the cost for the arrangement, repair and maintenance of entrances (exits, junctions) is under responsibility of the owners of these objects.

As for the barriers, the corridor road passing through Zhambyl oblast is not equipped with curved bars. Moreover, there are no restrictions on construction of new objects except for cases affecting the road safety.

In addition, in view of the completion of "WE-WC" a moratorium on the construction of the roadsie service objects does not cover.
