As a response «Dogus Insaat ve Ticaret AS» submitted a letter No. DGJV/EWRP 0-112/DEng-1750 dated 18 November 2014, where the Contractor indicates that he held negociations with "Dominos Food Systems" LLP regarding procurement of dowel bars for concrete pavement. And in particular, the letter states that:
“As you are already aware, the Employer firstly decided to use fully synthetic covered dowels instead of half covered or paint coated dowels in order to have less adhesive between concrete and the dowel bars.
Secondly, the Employer demanded that dowels certificated by KazdorNII.
These changes naturally delayed the negociations with the suppliers. The Contractor in order not to lose time and no to suspend the concrete paving due to lack of dowels; signed the procurement contract with the first supplier who fulfilled all the requirements stated in the Technical Specifications and additional demands of the Employer.
For providing the dowels the contract was signed on September 16, 2014 and the first batch was deliviered to the site on September 22, 2014.
In the meantime nrgociations with the subjected company continued and they could provide the certificate from KazdorNII only on September 23, 2014 which is after the signing the contract mentioned above. Also said company stated that they would provide the steel material from Russia and this will take arounf 30 days after signing the contract and transferring the payment. Following the providing the steel material from Russia, Mr. Musayev planned to cut and cover the dowels in Almaty and for this procedure he demanded also time.
From negiciations for delivering procedure in came out that “Dominos Food Systems” LLP has no experience in this field. It is a fact that this work item is very critical and any delay in supplying can be caused due to inexperience of this company shall effect the project significantly in adverse manner. Considering inexperience of this company and since the contractor already signed a contract with a trustable company who can deliver the required amount of material within 1 week, it has been concluded to not to trade with Dominos Food Systems.
As a summary, the Contractor not only considered the lowest pice but also safe and smooth procurement and delivery of the material.
As a final note, we wish to state that nit price stated in the claim of Mr. Musayev is totally not correct and in our company no person named as Hakan Okber is working.”
